I think it's hilarious. However, if he is licensed by the state to provide a service (in this case CHL instructorship), it's not necessarily his right to deny that service to people based on religion. Not sure about political affiliation, though...

True, the state could impose restrictions or specifications/guidelines and set other legalities which might prevent him from operating his business in the way he sees fit. However, it is possible that because of its educational bent, that he might qualify for the same sort of rights that a private educational facility does (similar to how charter schools are only required to meet a minimum of state standards and don't need to follow every letter of the law that public schools do, and yet still receive government funding). The only surefire way to know is to examine Texas and Federal law regarding this sort of matter.

Agreed as to the last sentence. I'm not sure if the school analogy works; I don't think public money pays for any school that prohibits people based on religion (but I could be wrong).
